Bob has more than thirty years of experience handling a broad range of environmental law matters, including those related to environmental compliance, complex commercial litigation, and corporate transactions.

He advises clients with respect to potential environmental liabilities at contaminated sites (including issues under Superfund and RCRA); permitting matters; civil and criminal enforcement proceedings relating to air emissions, wastewater discharge, toxic substance manufacture and use, and hazardous waste handling requirements; the licensing of power plants; environmental impact analyses; toxic tort claims; and related insurance matters.

Bob has led environmental assessments and compliance reviews of several companies with numerous facilities in many countries, and has represented a variety of companies in multi-party, multi-million dollar cost recovery litigation involving contaminated sites in several jurisdictions. He successfully represented an aircraft manufacturer in an action by the Federal government seeking penalties for alleged failure to comply with air emission requirements, a tire manufacture in an action by residents of a mobile home park seeking damages for alleged exposure to hazardous substances, a manufacturer of water well pumps regarding claims of alleged damage from toxic materials contained in drinking water, and has negotiated consent orders with Federal and State environmental regulators involving remediation of contaminated sites, and various permitting issues. He also helps companies to establish and implement compliance and audit programs.

In corporate matters, Bob represents commercial and investment banks, private equity firms, industrial and other companies in the structuring of transactions (including mergers, acquisitions, securities offerings, lending and other financing arrangements) relative to environmental risks and available means to address them.

Earlier in his career, Bob served as Deputy Commissioner and General Counsel of the New York State Department of Environmental Conservation, Deputy General Counsel for programs at the United States Department of Energy, and Special Counsel, Energy and Environmental Matters, for the New York State Assembly.

Bob is recognized among the top environmental lawyers in New York by Chambers USA.

 
PROFESSIONAL ACTIVITIES:

Bob serves on the Executive Committee of the Environmental Law Section of the New York State Bar Association and co-chairs the Corporate Counsel Committee. He serves on the International Law and the Solid and Hazardous Waste Committees of the American Bar Association’s Section of Natural Resources, Energy and Environmental Law. He is a Vice-Chair of the Board of Directors of the non-partisan New York League of Conservation Voters, where he also co-chairs the Endorsement Committee.

Bob became a partner in 1981.
