Bankruptcy and Out-of-Court Restructuring
Cahill lawyers have significant experience representing debtors and borrowers. For example, we are representing SP Newsprint Holdings LLC and CB Holding Corp. (d/b/a Charlie Brown's Steakhouse) in their Chapter 11 bankruptcy cases currently pending before the United States Bankruptcy Court for the District of Delaware, and recently represented Trico Marine Services and Orleans Homebuilders in all aspects of their Chapter 11 filings in the District of Delaware, and Aurora Oil & Gas and BH S&B Holdings (d/b/a Steve & Barry's) in all aspects of their Chapter 11 filings in the Western District of Michigan and Southern District of New York, respectively. We have also served as special counsel in the Chrysler, Bear Island, and Fairchild Corporation bankruptcy cases. We are advising a major former law firm in an out-of-court wind-down and have advised a print media company in an out-of-court restructuring.
Further, we counsel DIP lenders, exit lenders, underwriters, funds, and equity sponsors/investors in bankruptcy and restructuring matters, including in the Abitibi-Bowater, Neff Corp., General Motors, Lyondell Basell, Rath Gibson, Foamex, Formica, Exide Technologies, RCN Corp., Northwest Airlines, and Seitel bankruptcy cases. We also represent purchasers of distressed assets out of bankruptcy and represented Falcon Mezzanine Partners as a buyer in a Section 363 sale of the assets of Centrix Financial.
We also advise creditors, boards of directors, bondholders, official and ad hoc committees, foreign representatives, and trustees in bankruptcy and domestic and foreign restructuring and insolvency matters, and our lawyers actively participated in the bankruptcy cases of Lehman Brothers, Vertis, Madoff Securities, Source Interlink, North General Hospital, Crucible Materials, Tribune, Smurfit Stone, Philadelphia Newspapers, Charter Communications, Bayou Funds, Delphi, Refco, and United Airlines and in other out-of-court restructuring matters.
In addition, we assist clients in litigation situations with respect to various debtor/creditor issues, including claims objections, preferences, fraudulent conveyances, debt recharacterization, equitable subordination, deepening insolvency, lender liability, and other related litigation matters, both prior to and during bankruptcy and other judicial proceedings.
Financial Restructuring
We have extensive experience in a range of restructuring transactions, such as exchange offers and cash tender offers.
