Federal Trade Commission Again Extends Enforcement of "Red Flags Rule" Through December 31, 2010

COMMUNICATIONS ALERT

As previously reported, the Identity Theft Red Flags Rule ("Rule") was due to take effect on June 1, 2010. According to a Federal Trade Commission press release issued Friday, May 28, 2010, the FTC is further extending its deferral of enforcement of its Red Flags Rule through December 21, 2010 at the request of Congress. The Rule became effective January 1, 2008, with full compliance required by November 1, 2008. Enforcement of the Rule, however, has been extended several times. Congress has requested the delay to permit it to finalize legislation, which is intended to limit the scope of businesses covered by the Rule.
