MarineMax Secures Summary Judgment Ruling in Breach of Contract Case

Cahill secured a summary judgment ruling for MarineMax, Inc., the nation’s largest recreational boat retailer, in a case brought by Plaintiffs who sold their boat business to MarineMax in 2006, asserting various claims relating to the release of restrictions on the stock issued to them in connection with the acquisition. Following a motion to dismiss, Plaintiffs’ claims were narrowed to a single breach of contract claim, and MarineMax moved for summary judgment after discovery. On August 22, the U.S. District Court for the Eastern District of New York granted MarineMax’s motion, finding that “the evidence fails to establish a genuine issue of material fact for trial."
