Court Stays $500 Million Purported Class Action and Compels Arbitration

Cahill is national counsel in a series of class action lawsuits filed against Time Warner Cable Inc. (“TWC”) in connection with its October 2012 decision to begin charging a monthly modem lease fee.  One action, filed by a series of plaintiffs purporting to represent classes of TWC subscribers in California, New Jersey and New York, alleged breach of contract and violation of various consumer protection statutes and sought over $500 million in damages.  TWC moved to compel arbitration pursuant to the terms of its contract with each of the plaintiffs, and the United States District Court for the Eastern District of New York granted the motion and stayed the litigation pending arbitration of the plaintiffs’ claims.
