Partner Joel Kurtzberg Awarded the 2019 National Press Photographers Association’s First Amendment Award

The National Press Photographers Association has named Cahill partner Joel Kurtzberg as a 2019 recipient of the “Alicia Calzada First Amendment Award” in recognition of his work on behalf of photojournalist Jason Nicholas in Nicholas v. Bratton​, a case that has the potential to reform NYPD procedures for handling the seizure of journalists’ press credentials. This award from the NPPA recognizes those who have worked to promote and advance the First Amendment, especially as it relates to visual journalists.

Since 2017, Joel Kurtzberg has represented photojournalist Jason Nicholas in his civil rights action concerning First Amendment, Equal Protection, and Due Process violations arising out of his removal, by the NYPD, from an accident scene and the City’s improper seizure of his press credential. In March 2019, the court held in a significant ruling that the police violated Mr. Nicholas’ due process rights as a matter of law. Defendants in the case include various police officers, then-New York City Police Commissioner William Bratton, and the City of New York.
