Patrick Lafferty is a partner in the firm's Intellectual Property practice. An experienced patent litigator registered before the U.S. Patent and Trademark Office (USPTO), he advises clients on patent strategy, portfolio risks, validity challenges, and enforcement matters.
Patrick has extensive experience representing clients in high-stakes intellectual property disputes across the country's leading patent venues. He has litigated matters in many of the nation's most active patent forums, including the Eastern and Western Districts of Texas, the District of Delaware, and the Northern District of California. In addition to substantial experience before the U.S. Patent and Trademark Office, including inter partes review and ex parte reexamination proceedings, he has represented clients in Section 337 investigations before the International Trade Commission.
Patrick's patent litigation and counseling practice focuses on a broad range of technologies and critical matters involving cybersecurity, fiber optics, wireless communication technologies and standards, semiconductors, artificial intelligence, encryption and network security, distributed networks, telecommunications, software applications, FinTech, and Standard Essential Patents (SEPs).
Holding a degree in electrical engineering, Patrick combines technical knowledge with deep experience managing complex patent disputes through trial, appeal, and administrative proceedings. He has represented and litigated against some of the world's largest technology and life sciences companies in disputes involving critical products, core technologies, and significant business interests.
- Represented OpenText and Webroot in competitor v. competitor cases against five separate defendants involving over 40 patents and 40+ United States Patent Office proceedings in cybersecurity and endpoint protection technologies.*
- Represented Motive Technologies and Platform Science in separate litigations defending against patent infringement claims filed by Omnitracs and XRS corporation concerning vehicle telematics systems.*
- Represented multiple clients adverse to Intellectual Ventures concerning a range of technologies including cellular and Wi-Fi standard essential patents, open-source software (including Docker, Kubernetes, Kafka, and Spark/PySpark), RFID technology, and in-vehicle networks.*
- Represented Amtech Systems LLC against Kapsch in competitor vs. competitor patent litigation at the International Trade Commission on RFID technology used in electronic toll collection.*
- Represented major smartphone manufacturer in cases concerning cellular baseband chipsets and standard essential patents (SEPs), including antitrust/FRANDclaims, as well as related patent proceedings at the ITC and around the world (e.g., the Korean Fair Trade Commission).*
- Represented a semiconductor design company in patent litigation against a major semiconductor manufacturer concerning dynamic logic circuits located in the register files of microprocessors.*
- Represented software company ROY-G-BIV in patent litigation against ABB, Honeywell, and Siemens on motion control software patents used in process control plants.*
- Represented Sanofi in Hatch-Waxman litigation against Merck concerning insulin glargine and mechanical pen injectors.*
- Represented Uber against Waymo in trade secret and patent infringement litigation concerning autonomous vehicle technology.*
