Partner and chair of Cahill’s Life Sciences Patent Litigation practice, Gerald Flattmann, and counsel Andy Cochran spoke at the American Conference Institute’s (ACI) 18th Annual Paragraph IV Disputes Conference on Thursday, April 20, 2023.
Gerald’s panel, “Preparing for Parallel Proceedings: Maneuvering through the District Court and Inter Partes Review,” discussed strategies or parallel proceedings in the District Courts and PTAB and consider the takeaways from the patent challenger’s perspective in addition to the patentee perspective. Andy’s panel, “Revisiting Damages in an At-Risk Launch Scenario: Questions of Remedies and Valuation,” explored questions of royalties, lost profits, and exceptional findings and examine grounds for mitigation.
