Keeps Review Bar High,” regarding the Federal Circuit's dismissal of all mandamus petitions that sought to limit how the U.S. Patent and Trademark Office leadership assesses patent challenges. This ruling reinforces the appeals court’s exceptionally high standard for reviewing institution decisions.
Alfonso stated, “petitioners who filed the inter partes reviews ended up taking it for granted that they were going to get them.” He further elaborated that there is no structural issue that the Federal Circuit perceives needs correction, particularly since companies still have the option to contest the same patents through ex parte reexaminations or in district court.
