Cahill Successfully Defends Natixis S.A. Against Fraudulent Conveyance Claims in New York

Cahill secured the complete dismissal of all claims asserted against Natixis S.A. in a proceeding brought by TransAsia Commodities Investment Limited in New York County Supreme Court.  The action, which named Natixis among more than sixty respondents, alleged that Natixis facilitated fraudulent asset transfers in connection with international finance transactions.  The court granted Natixis's motion to dismiss on four independent grounds.

First, the court held that petitioner's sprawling, 254-page petition violated New York's pleading requirements by failing to give fair notice of the claims asserted against Natixis.  Second, the court dismissed for lack of personal jurisdiction, finding that neither general nor specific jurisdiction exists over Natixis, a French bank with no relevant contacts to New York.  Third, the court held that the claims were barred by the statute of limitations.  Fourth, the court dismissed on forum non conveniens grounds, concluding that this dispute between a UK-based petitioner and a France-based respondent should not be litigated in New York.
