Cahill and Sanctuary for Families Prevail on Behalf of Domestic Violence Survivor on Appeal

Cahill and co-counsel Sanctuary for Families successfully represented a domestic violence survivor in an appeal before the Appellate Division, Second Department. As a result of Cahill’s representation, the client maintained full custody of her son. The father sought to overturn the dismissal of his petition to modify a final custody order granting full custody to the mother, arguing that his petition should not have been dismissed without a hearing. The Second Department held that the father’s petition was insufficient to meet the threshold evidentiary showing of a change in circumstances sufficient to warrant a hearing and affirmed the dismissal.
