Cahill Secures Complete Dismissal of ATA Claims Against Binance

Cahill secured a significant victory for Binance, the world’s largest cryptocurrency exchange, obtaining dismissal of a complaint brought under the Anti-Terrorism Act (“ATA”) alleging that entities operating the Binance.com exchange aided and abetted terrorist attacks, conspired with the attackers, or were subject to primary liability for providing direct support for the attacks.

On March 6, 2026, U.S. District Judge Jeannette A. Vargas  of the Southern District of New York granted defendants’ motions to dismiss in full and dismissed all claims. Judge Vargas agreed with the Cahill defense team that the complaint failed to plausibly allege that the defendants knowingly and substantially assisted the terrorist attacks at issue (as required to state aiding and abetting claims), entered into a conspiracy with the perpetrators, or directly supported any violent or dangerous acts. The Court further concluded that plaintiffs did not establish a definable nexus between the defendants’ conduct and support for the attacks. Plaintiffs will have an opportunity to amend their complaint.
