Elai Katz Authors Chapter in New York Antitrust and Consumer Protection Law (Third Edition)

Cahill Partner Elai Katz authored a chapter entitled New York Antitrust Law-The Donnelly Act in the New York State Bar Associations' recently published New York Antitrust and Consumer Protection Law (Third Edition, 2011). The chapter reviews the legislative history and contemporary judicial interpretations of New York's antitrust law, including notable immunities, exemptions and defenses. It also highlights some of the key differences between the federal Sherman Act of 1890 and New York's Donnelly Act, passed in 1899, which, liked antitrust statutes in other states, has been used to apply competition law principles when federal antitrust law is considered unduly limited or inefficient.
