On June 19, 2006, the Court of Appeals for the Tenth Circuit decided In re Qwest Communications Int’l Securities Litigation, holding that Qwest waived its attorney-client privilege and nonopinion work-product protection by voluntarily producing documents to the SEC and DOJ in connection with those agencies’ investigations, notwithstanding a "loose" confidentiality agreement.
